RENTAL AGREEMENT TERMS AND CONDITIONS

⚠ IMPORTANT: ONLY ONE DRIVER PER RENTAL

Only the single person listed as the Authorized Driver in this Agreement may operate the rental vehicle, except in the case of an approved Road Test Driver.

A Road Test Driver is a licensed or permitted driver who has been specifically approved by Star Car Rental solely for the purpose of taking an RMV road test in the rental vehicle. The Road Test Driver must meet all eligibility requirements, provide required identification, and may operate the vehicle only during the official road test.

Allowing anyone other than the Authorized Driver or an approved Road Test Driver to operate the rental vehicle is a breach of this Agreement and will void all coverage, including any Damage Waiver purchased.

A. DEFINITIONS:

Agreement: All terms and conditions on this form, any addenda, and any additional materials provided by Us at the time of rental.

Authorized Driver: The single person approved by Us and listed on this Agreement as the primary driver of the rental vehicle. This person must meet all eligibility requirements and be verified before the rental begins. No other person may operate the vehicle except an approved Road Test Driver.

Road Test Driver: A licensed or permitted driver who has been specifically approved by Us in writing for the sole purpose of taking an RMV road test in the rental vehicle. The Road Test Driver must meet all eligibility requirements, provide required identification before the rental begins, and may operate the vehicle only during the official road test.

Physical Damage: Damage to or loss of the rental vehicle caused by collision or upset. Physical damage does not include damage to or loss of personal items due to theft, vandalism, acts of nature, civil disturbance, hail, flood, or fire.

Rental Vehicle: The automobile identified in this Agreement and any substitute vehicle. The rental vehicle includes all tires, tools, accessories, equipment, keys, and vehicle documents.

You or Your: The person signing this Agreement as the renter and any Authorized Driver or approved Road Test Driver. Only one Authorized Driver is permitted per rental. This may be the renter or another person designated at the time of booking (e.g., a road test driver), but must be approved by Us and meet all eligibility requirements. All parties identified as “You” or “Your” are jointly and severally liable for obligations under this Agreement.

B. RENTAL:

This Agreement is a contract for the rental of the rental vehicle. If the rental vehicle is abandoned or used in violation of law or this Agreement, We may repossess the rental vehicle at Your expense without notice. If You permit anyone other than an Authorized Driver to operate the rental vehicle, the Agreement is considered breached and such permission is a willful and reckless act. If the vehicle becomes disabled beyond authorized radius, You will be charged for towing the vehicle back to its home office.

C. RENTAL VEHICLE OPERATION:

The Agreement is breached if:

1. You intentionally, willfully, or wantonly damage the rental vehicle.

2. You operate the rental vehicle while intoxicated or under the influence of alcohol, drugs, or chemicals as defined by law.

3. You operate the rental vehicle in any speed contest.

4. You push or tow anything or transport persons or property for compensation.

5. You operate the rental vehicle outside of the United States, its territories, or Canada (except as authorized).

6. You allow an unauthorized driver to operate the rental vehicle.

7. You damage the rental vehicle in connection with any criminal or illegal act.

8. You provide Us with fraudulent or false information before or during the rental, or fail to provide updated information such as telephone or address changes.

9. Identity Verification Requirement

The Authorized Driver must upload (a) a clear photo of their valid driver’s license and (b) a selfie holding that license next to their face prior to vehicle pickup. This verification step is required for all rentals to confirm the Authorized Driver’s identity. Bookings without completed verification will be canceled. Use of any driver other than the Authorized Driver, except for an approved Road Test Driver during the official road test, is considered an unauthorized driver and a breach of this Agreement.

10. GPS Tracking Requirement

All rental vehicles are equipped with GPS tracking devices. You may not remove, disable, damage, or tamper with the device for any reason. Doing so will result in a $350 charge and may result in immediate termination of your rental.

D. RETURN AND MAINTENANCE:

You must return the rental vehicle to the same location at which it was rented, unless otherwise noted in this Agreement, on or before the due date and time stated. Any return on Saturday, Sunday, Federal or State holidays, or after hours will be processed the next business day. You are responsible for returning the rental vehicle in the same condition as when rented, except for ordinary wear. You must maintain all fluid levels.

Return Photo Requirement

All renters must upload clear return photos through the provided link before leaving the vehicle. Required photos include:

Front, back, and both sides of the vehicle
Odometer showing mileage and fuel level
Lockbox secured on the driver’s window

Failure to provide return photos may result in a documentation fee of $25 and/or the renter being held responsible for any unverified damage, fuel shortages, or mileage discrepancies identified after return.

E. INDEMNIFICATION, EXCESS LIABILITY, AND WARRANTIES

⚠ You are responsible for all accident costs above our insurance limit.

If you cause damage or injuries that cost more than our insurance covers, you must pay the rest.

You acknowledge that the Owner (“Lessor”) carries only the minimum liability insurance required by the Commonwealth of Massachusetts: $20,000 per person / $40,000 per accident for bodily injury, and $5,000 per accident for property damage. You agree that you are fully and solely responsible for any and all claims, damages, losses, costs, expenses, or liabilities (including attorney’s fees) that exceed these limits, whether for bodily injury, property damage, or any other loss.

You shall indemnify and hold the Lessor harmless from all such excess amounts and from all claims, liability, costs, and attorney fees incurred resulting from or arising out of this Agreement and your use of the rental vehicle. This includes, but is not limited to, any claims made after the rental period arising from events that occurred during the rental period, and applies regardless of whether the loss or damage was caused in whole or in part by your negligence or the negligence of any other driver or person in possession of the vehicle.

WE MAKE NO EXPRESS, IMPLIED, OR APPARENT WARRANTIES REGARDING THE RENTAL VEHICLE, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. You agree that we are not responsible for loss or damage to any personal property in or on the rental vehicle or on our premises.

F. PHYSICAL DAMAGE OR LOSS:

Regardless of fault, You are responsible for all damage to, loss of, loss of use of, reduction in value of the rental vehicle, including missing equipment and reasonable administrative fees associated with any damage claim. You must immediately report to the police and to Us any accident, theft, vandalism, or incident within 24 hours, and provide Us with a police report within 72 hours, otherwise You are in violation of this contract.

G. DAMAGE WAIVER / ROAD HAZARD / INSURANCE REQUIREMENT:

Insurance Requirement

All renters must either (a) upload valid proof of personal auto insurance that includes coverage for rental vehicles prior to pickup, or (b) keep the Damage Waiver at a rate of $40.00 per day.

If valid proof of insurance is not uploaded and approved before the rental begins, the Damage Waiver will remain on the booking and will be charged.

This requirement is mandatory for all renters—no exceptions.
Damage Waiver Terms

If you purchase the Damage Waiver, you agree to pay the daily fee stated in your rental agreement. This waiver covers all physical loss or damage to the rental vehicle during the rental period—regardless of fault or cause, including but not limited to:

Collision
Theft
Vandalism
Fire
Weather-related damage
Road hazards

There is no deductible and no cap on the amount covered.

The waiver is void if you violate any terms of this Agreement, including but not limited to using unauthorized drivers, operating the vehicle under the influence, or submitting false information during booking.

Lost Keys

If the rental vehicle key is lost, damaged, or not returned, the renter will be charged a replacement fee of $200. This is covered under the Damage Waiver if purchased.
Road Hazard Coverage (if Waiver Not Purchased)

If you opt not to purchase the Damage Waiver and instead provide your own insurance, you may purchase optional Road Hazard Coverage. This waives all claims against the renter for damages to tires, rims, and hubcaps during the rental period. Road Hazard Coverage is void if the renter violates any terms of this Agreement.

H. SECURITY DEPOSIT / PRE-AUTHORIZATION HOLD:

At the start of the rental, a $400 pre-authorization hold will be placed on the renter’s credit or debit card. This hold is not a charge and will be released after the rental is completed, provided the vehicle is returned on time, undamaged, with a full fuel level (as specified), and without outstanding fines, tolls, or fees. If additional charges are due, the amount may be deducted from the hold before the remaining balance is released.

I. LIABILITY INSURANCE:

We are NOT responsible for damage or loss that You cause to others. Our vehicles are covered under a commercial auto policy that meets Massachusetts minimum liability requirements. This coverage applies to the Authorized Driver listed on this Agreement while operating the rental vehicle in accordance with its terms.

Coverage also applies to an approved Road Test Driver only during the official RMV road test when operating the rental vehicle in accordance with the terms of this Agreement. If a renter has their own auto insurance policy, that policy may also provide coverage. The renter is responsible for any deductibles, damage, or expenses not covered by insurance or this Agreement.

J. PAYMENT AND CHARGES:

You agree to pay all charges incurred under this Agreement, including but not limited to:

1. Charges for optional services purchased by You.

2. Time and mileage charges until the rental vehicle is properly returned.

3. Additional driver charges.

4. If the vehicle is returned with less fuel than it had at the start of the rental, a refueling fee will apply. Charges are based on fuel gauge readings in ⅛ increments, billed at $12 per ⅛ tank.

5. Cleaning and detailing fees if the rental vehicle is returned in poor condition.

6. A $100 fee will be charged for any key lockbox that is lost, damaged, tampered with, or not returned in working condition at the end of the rental.

7. All location and recovery expenses if You fail to return the rental vehicle as agreed.

8. Minimum recovery fee of $50.00 and $5.00 per mile for vehicle repossession.

9. The fair market value of the rental vehicle at the time of damage, loss, or theft.

10. All expenses, fines, penalties, forfeitures, towing, storage, or administrative fees assessed against You, Us, or the vehicle.

11. A late fee of 1.5% per month on all unpaid amounts.

12. A fee of $5.00 will be charged if the vehicle is returned without the provided charge cable.

13. A $150.00 late return fee will be charged if the vehicle is returned past the agreed rental period without prior authorization.

14. A $25.00 per day fee applies if the renter or additional driver is under the age of 25.

15. For a fee of $15.00 per day, renters may purchase unlimited mileage for the rental period.

16. If unlimited mileage is not purchased, a fee of $0.25 per mile will apply for all miles driven over the included mileage.

17. A $150.00 cleaning fee will be charged if the vehicle is returned with evidence of smoking.

18. A $150.00 fee will be charged if the vehicle is returned excessively dirty or requires special cleaning.

19. No pets or animals of any kind are allowed in the rental vehicle. A $150 cleaning fee will apply if the vehicle is returned with pet hair, odor, or evidence of animals.

K. MODIFICATION, WAIVER, AND SEVERABILITY:

Any change, waiver, or modification of this Agreement must be in writing executed by Us. No acceptance of payment after a breach constitutes a waiver. If any part of this Agreement is held unenforceable, the remaining terms remain valid and enforceable.

L. TRAFFIC VIOLATIONS AND FINES

You are solely responsible for any traffic, parking, toll, or other violations that occur during your rental period. This includes, but is not limited to, speeding tickets, red light violations, toll evasion, and improper parking. If we receive notice of a violation that occurred while the vehicle was in your possession, we may charge your payment method on file for the full amount of the fine, plus a $25 administrative processing fee per incident. We may also provide your name and contact information to the issuing authority if required by law.

M. TOLLS & ADMINISTRATIVE FEES

All rental vehicles are equipped with a Massachusetts E-ZPass transponder for your convenience. Any tolls incurred during your rental will be billed directly to the credit card on file.

A $3 administrative fee will be added per toll transaction to cover processing and reporting costs.

Please do not remove, tamper with, or substitute the provided transponder. Doing so may result in additional charges.

N. GPS TRACKING

All rental vehicles are equipped with GPS tracking devices for location monitoring, mileage verification, theft prevention, and recovery. These devices include tamper detection, which alerts us if the unit is disconnected, disabled, or otherwise interfered with. By signing this Agreement, you consent to the use of such devices during your rental period. Removing, disabling, damaging, or otherwise tampering with the GPS device is strictly prohibited and will result in an immediate $350 charge plus any costs associated with repair or replacement. If a GPS tracker is lost or missing during your rental period, you will be charged $350 for replacement. Star Car Rental reserves the right to terminate the rental without refund if tampering is detected.
